The Trained AI Employee

1. Agreement to Terms

These Terms of Service ("Terms") are a legally binding agreement between you ("Member" or "you") and Polished CRM LLC, doing business as The Trained AI Employee ("Company," "we," "us," or "our"), the operator of The Trained AI Employee membership platform ("Platform"). By accessing or using the Platform in any way, including creating an account, purchasing a membership, or consuming any content, you agree to be bound by these Terms.

If you do not agree to these Terms, do not access or use the Platform.

2. About the Platform

The Trained AI Employee is an educational membership platform that provides small business owners with AI tools, templates, digital content, courses, live coaching, and community access to help them implement artificial intelligence in their businesses. The Platform is operated by Polished CRM LLC (DBA The Trained AI Employee).

3. Membership Plans and Access

3.1 Available Plans

The Platform offers multiple membership tiers, including monthly subscriptions, annual subscriptions, and one-time purchase options. The specific features, pricing, and access levels for each plan are described on our pricing page and are subject to change with reasonable notice.

3.2 Account Registration

To access the Platform, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized use of your account.

3.3 Access and Deliverables

Depending on your membership plan, you may receive access to any combination of the following:

Digital content including courses, guides, and training materials

AI tools, prompt templates, and workflow resources

Live coaching sessions or group calls

Community access and peer support

Access to specific deliverables is determined by your active membership tier. We reserve the right to update, add, or modify available content and features at any time.

4. Billing, Payments, and Cancellation

4.1 Billing

By purchasing a membership, you authorize Polished CRM LLC to charge your selected payment method at the rate associated with your chosen plan. Subscription fees are billed in advance on a recurring basis (monthly or annually, as applicable). One-time purchases are charged at the time of transaction.

4.2 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at [email protected]. Cancellation will take effect at the end of your current billing period. You will retain access to the Platform through the end of your paid term.

4.3 Refund Policy

All sales are final unless otherwise stated at the time of purchase. We do not offer refunds for partial billing periods or unused access. If you believe you were charged in error, please contact us within 7 days of the charge at [email protected] and we will review your request.

4.4 Price Changes

We reserve the right to change membership pricing. We will provide at least 14 days advance notice of any price increase before it takes effect for existing subscribers.

5. Intellectual Property

5.1 Our Content

All content on the Platform, including but not limited to course materials, templates, AI tools, written content, graphics, videos, and branding, is owned by or licensed to Polished CRM LLC and is protected by applicable copyright, trademark, and intellectual property laws.

5.2 Your License

Upon active membership in good standing, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use Platform content for your own personal business purposes. You may not:

Copy, reproduce, distribute, or resell any Platform content

Share your account credentials or access with others

Use Platform content to create competing products or services

Remove any copyright or proprietary notices from content

5.3 Your Content

If you submit content to the Platform (such as community posts or feedback), you grant Polished CRM LLC a non-exclusive, royalty-free license to use, display, and share that content in connection with operating and promoting the Platform.

6. Acceptable Use

You agree to use the Platform only for lawful purposes and in a manner consistent with these Terms. You agree not to:

Harass, threaten, or harm other members or staff

Share, distribute, or resell your access or credentials

Upload or transmit harmful, offensive, or illegal content

Attempt to gain unauthorized access to the Platform or its systems

Use the Platform in any way that could damage its reputation or operation

We reserve the right to suspend or terminate your account at any time for violations of this section without refund.

7. AI-Generated Content Disclaimer

The Platform teaches members how to use AI tools, including tools powered by third-party AI providers. Content generated through AI tools is provided for educational and business productivity purposes only. Polished CRM LLC makes no representations or warranties regarding the accuracy, completeness, or fitness for a particular purpose of any AI-generated output. Members are solely responsible for reviewing and using AI-generated content appropriately in their businesses.

8. Disclaimers and Limitation of Liability

8.1 No Guarantees

The Platform is provided on an "as is" and "as available" basis. We make no guarantees regarding specific business outcomes, revenue results, or the performance of AI tools taught on the Platform. Individual results will vary.

8.2 Limitation of Liability

To the fullest extent permitted by applicable law, Polished CRM LLC and its owners, officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or reliance on its content. Our total liability to you for any claim shall not exceed the amount you paid to us in the 90 days preceding the claim.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at www.aitrainedemployee.com/privacy to understand our data practices.

10. Third-Party Tools and Services

The Platform may reference or integrate third-party tools, platforms, or services (including AI tools, CRM platforms, and marketing software). We are not responsible for the availability, accuracy, or terms of those third-party services. Your use of any third-party service is governed by that service's own terms and policies.

11. Modifications to These Terms

We reserve the right to update these Terms at any time. When we make material changes, we will notify you via email or a notice within the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date constitutes your acceptance of the updated Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless both parties agree otherwise in writing.
